A provisional patent application is an approval document that the Indian Patent Office provides to the applicant. It helps protect a new invention from being copied by others and they will not be able to file the same invention in the provisional duration of 12 months before the formal application of the unique invention. When the invention is in the research and development phase, it is applied for the priority right of the invention.
If you notice that any product or invention is marked as “Patent Pending”, it has been submitted for Provisional Patent. Contact Online Legal India to apply for the Provisional Patent category.
The following are the benefits of a Provisional Patent Application:
Established priority date: Provisional patent is applicable from the date of application. So, if anybody wants to submit any similar invention later, it will not be approved for PPA.
Getting time for development: The applicant will have 12 months from the date of application to submit the finally developed invention, but the patent will remain secure.
Cost-Effective Option: PPA is significantly cheaper when you apply for it. So, every inventor can afford it.
Attract Investors and Collaborators: This application protects your invention for 12 months from the date of application. Hence, after successfully launching the product in between, you can easily attract customers and investors, for you are the sole inventor.
You must ensure that your unique invention has novelty, utility, inventive step/non-obviousness, industrial applicability, and the perfect invention description. If the invention has no mass utility or industrial applicability, your invention will not get a patent. So, choose such a project that qualifies for the aforementioned factors.
Novelty: The invention must be new and must not be known to the public before the filing date of the provisional application. Along with these terms, any disclosure through publications, sales, or presentations in the public for any reason is extremely prohibited. Otherwise, the patent might be canceled.
Utility: The invention must have some utilities and practical usage that gives the common people or industries a lot of benefits in any respect.
Description: The description of the machine or any invention that you have done must be easily described so that the experts in the field can easily understand the invention and its usability, functionality, assembly, and required components.
Inventiveness: The invention must not be the advancement of the previous invention or the known knowledge in the same field. It should have significant inventions beyond the known inventions and knowledge.
